PIPEDA and Your Practice – A Privacy Handbook for Lawyers

The Office of the Privacy Commissioner of Canada has recently released a handbook written by lawyers for lawyers entitled “PIPEDA and Your Practice - A Privacy Handbook for Lawyers”. This handbook explains how the Personal Information and Protection and Electronic Documents Act (PIPEDA) relates to the everyday practice of lawyers in the private sector.

PIPEDA itself regulates the collection, use and disclosure of personal information in manner that recognizes the right to personal privacy. This handbook describes best practices when managing personal information when, for example, responding to requests for access to personal information. It also addresses privacy issues in the course of managing a law firm and conducting litigation.

It is important to note that this handbook does not address the privacy requirements that may apply to Crown counsel and public sector lawyers.
